Terms of Service

Minecraft Development & Creative Services A service team operating under the laws of the Republic of Serbia

1. General

These Terms of Service ("Terms") govern every commission, order, and interaction carried out through FWL Studios ("FWL", "we", "us", or "our"), a Minecraft-focused service team operating under the laws of the Republic of Serbia. By opening a ticket, placing an order, or otherwise engaging one of our freelancers, you ("the Client", "you") confirm that you have read, understood, and agree to be bound by these Terms in full. If you do not agree with any part of these Terms, we will decline to provide the requested service. We may update these Terms at any time, with or without prior notice, and it is your responsibility to review them periodically. Continued use of our services after an update constitutes acceptance of the revised Terms.

2. Definitions

• Client: any individual or entity that opens a ticket or places an order with FWL Studios.
• Freelancer: an independent contractor engaged by FWL Studios to deliver a commissioned service (e.g. builder, developer, designer).
• Management: the FWL Studios staff members responsible for overseeing tickets, approving refunds, and enforcing these Terms.
• Service(s): any digital good, build, plugin, bot, graphic, or other work commissioned through FWL Studios.
• Commission: the specific project, together with its agreed price, scope, and deadline, undertaken by a Freelancer for a Client.
• Platform: the FWL Studios Discord server, through which all commissions are opened, discussed, and delivered.

3. Nature of Our Services

All goods and services offered through FWL Studios are digital in nature. As such, we cannot be held responsible for any loss, corruption, or damage to a delivered product, or to the system, server, or account on which it is used, once the corresponding ticket has been marked as complete. Pre-made goods are sold as-is. Requests for alterations to a pre-made product are handled at the sole discretion of the Freelancer who created it, and may incur an additional charge. Management reserves the right to pause, reassign, or cancel a commission at any time if deemed necessary for the integrity of the Platform, the safety of our Freelancers, or compliance with these Terms — with or without providing a specific justification to the Client. If a Client requires a Freelancer to sign a Non-Disclosure Agreement, this must be raised with Management before work begins so that a Freelancer legally able to sign such an agreement can be assigned

4. Payment Terms & Accepted Methods

FWL Studios accepts payment through the following methods, subject to availability for your region and the nature of the commission:
• Wise
• PayPal (Goods & Services only)
• Bank Wire Transfer
• Payoneer
• Cryptocurrency (as agreed with Management on a per-commission basis)

Where PayPal is used, payment must be sent as Goods & Services; payments sent as Friends & Family will be refused. Bank wire, Payoneer, and cryptocurrency payments are generally irreversible once confirmed on the recipient's end, and the Client is responsible for verifying all payment details before sending funds. FWL Studios is not liable for funds lost due to Client error, such as sending payment to an incorrect wallet address or account.

Standard commissions require 50% of the agreed price upfront before work begins, with the remaining balance due upon completion and before final delivery. Commissions that require a Freelancer to work directly on a Client's live server require 100% of the agreed price upfront, given the elevated risk associated with performing work in a live environment.

Depending on the payment method selected, a processing or transaction fee may apply. Any such fee will be disclosed to the Client before invoicing and will be added to the final total. By opening a ticket with us, you agree to cover any applicable processing fees.

If the remaining balance is not received within a reasonable time following completion, FWL Studios reserves the right to withhold delivery, resell the completed work, and retain it as FWL Studios property.

5. Deadlines & Delays

A commission's deadline does not begin until the required upfront payment has been received in full. If the upfront payment is delayed, the original deadline will be pushed back by an equivalent number of days.

If a Freelancer fails to deliver a completed product by the agreed deadline without a valid reason, the Client may be entitled to a partial refund in accordance with Section 8 (Refund Policy).

Delays caused by the Client - such as slow responses, late payment, or unclear requirements - do not entitle the Client to a refund.

6. Revisions & Change of Scope

A reasonable number of revisions may be included in a commission, as agreed with the assigned Freelancer at the outset.

Any request that expands the original scope of work — rather than correcting a defect against the agreed brief — will be treated as a change order and may incur an additional charge.

To avoid disputes, Clients are encouraged to provide as much detail as possible before work begins. All scope, deliverables, and pricing should be clearly agreed and, where practical, confirmed in writing within the ticket before the Freelancer starts work.

7. Unsatisfactory Work

If a Client is not satisfied with a delivered product, the assigned Freelancer will make reasonable efforts to bring the work up to the agreed standard described in the original brief. A partial refund may be issued at Management's discretion where the final product still falls short after such efforts, in accordance with Section 8.

8. Refund Policy

As our products and services are digital goods, refunds are only issued in limited circumstances. Where a refund is approved, it is calculated against the base commission price and does not include any processing or transaction fees already incurred.

1. Missed deadline: 5% of the commission price per day late, up to seven days, then 10% per day thereafter, capped at a maximum of 75%.

2. Unsatisfactory product: up to a maximum of 15%, at Management's discretion, where remedial work under Section 7 does not resolve the issue.

3. Discretionary refund: Management may approve a refund of any percentage where it considers this fair, based on the specific circumstances of the ticket.

A Client is not entitled to a refund for a simple change of mind once a Freelancer has begun work. Where the full amount was paid upfront and a Client cancels before completion, Management may, at its discretion, compensate the Client for the portion of work not yet carried out. Chargebacks, payment reversals, or any attempt to recover funds outside of the informal resolution process described in Section 10, without first raising the issue with Management, will be treated as fraudulent. This will result in an immediate and permanent ban from the Platform, a permanent blacklist from all current and future FWL Studios services, and may be reported publicly as an attempted scam. Digital Content — Waiver of Withdrawal Right: our services consist of digital content that is not supplied on a tangible medium. By opening a ticket and requesting that a Freelancer begin work, you expressly request that performance start immediately and you acknowledge that, once work has begun or content has been supplied, you lose any statutory right of withdrawal or "cooling-off" period (including any 14-day right of withdrawal that may otherwise apply to distance or digital content purchases under applicable consumer-protection law). You expressly consent to this waiver and confirm that you understand you will not be entitled to a refund on this basis once a Freelancer has commenced work, save as set out elsewhere in this Section 8.

A Client who leaves the Discord server, or who is removed for a breach of these Terms, will have their commission cancelled without a refund. A Client found to be disruptive during an active commission — including but not limited to damaging a build, deleting files, or directing abuse at a Freelancer — will have their commission cancelled and may receive a partial refund of between 50% and 75%, at Management's sole discretion.

9. Communication & Language

All commission-related communication must take place within the FWL Studios Discord server so that Management can properly oversee each ticket. Commissions or agreements made outside the Platform, including via direct message, are not covered by these Terms, and FWL Studios accepts no responsibility for disputes arising from them.

Where a conversation takes place over voice chat, it is the Client's responsibility to agree with the Freelancer in advance whether the call will be recorded. FWL Studios will not act as an arbiter of what was or was not said in an unrecorded call. For record-keeping purposes, all communication within a ticket should be conducted in English.

10. Disputes

If a disagreement arises regarding a commission, the Client should first raise the matter with the assigned Freelancer and, if unresolved, escalate it to Management within the relevant ticket. Management will review the ticket transcript and any evidence provided before reaching a decision. Both parties agree to attempt to resolve any dispute informally and in good faith before pursuing any external or legal remedy.

As FWL Studios is registered in the Republic of Serbia, these Terms, and any dispute arising from them, are governed by the laws of the Republic of Serbia, without regard to conflict-of-law principles, and subject to the exclusive jurisdiction of the competent courts of Serbia, except where local consumer-protection law provides otherwise.

11. Intellectual Property & Portfolio Use

Unless otherwise agreed with Management in advance, completed work may not be resold, redistributed, or claimed as the Client's own creation without the express written permission of FWL Studios. Work discovered to have been resold without authorisation will be treated as FWL Studios property, and we reserve the right to pursue appropriate action.

Unless specifically agreed otherwise, FWL Studios reserves the right to showcase completed commissions in our portfolio and promotional material. We will not disclose a Client's name or identifying information in such material without separate permission. Any ideas, suggestions, or feedback submitted by a Client in connection with a commission may be used by FWL Studios without compensation or attribution.

12. Product Support & File Retention

Completed commissions include 30 days of support for issues directly caused by the original work. Issues arising from unrelated plugins, mods, bots, or third-party changes made after delivery fall outside the scope of this support. Support requested after the 30-day window is provided entirely at the Freelancer's discretion and may be chargeable.

Clients are responsible for downloading and independently backing up all files related to their commission. While some Freelancers may retain copies beyond the support period, they are under no obligation to do so, and FWL Studios accepts no liability for files lost after the 30-day period has elapsed.

13. Conduct on Live Servers

Where a commission involves a Freelancer accessing a Client's live server, both parties are expected to conduct themselves professionally. Freelancers are expected to take reasonable care of the Client's environment, and Clients are expected to grant only the access necessary to complete the agreed work.

FWL Studios is not liable for pre-existing issues on a Client's server, or for damage arising from Client-supplied credentials, plugins, or infrastructure.

14. Privacy

Personal information provided for invoicing purposes — including full names, email addresses, and payment details — is kept confidential and is not shared outside of FWL Studios Management. Every ticket is automatically logged as a transcript when closed; these transcripts are used to protect both Clients and Freelancers, and are visible only to Management.

15. Limitation of Liability

To the maximum extent permitted by applicable law, FWL Studios and its Freelancers shall not be liable for any indirect, incidental, special, or consequential damages — including but not limited to loss of data, loss of profit, or business interruption — arising from the use of, or inability to use, any product or service we provide.

Where liability cannot be excluded under applicable law, our total liability in connection with any commission is limited to the amount actually paid by the Client for that specific commission.

16. Indemnification

You agree to indemnify and hold harmless FWL Studios, its Management, and its Freelancers from any claim, damage, or expense — including reasonable legal fees — arising from your use of our services, your violation of these Terms, or your violation of the rights of a third party

17. Freelancer Recommendations

Freelancers may, at their own discretion, recommend related third-party products or services during a commission (for example, hosting providers or pre-made plugins). Such recommendations reflect the Freelancer's own opinion and are not endorsed by FWL Studios unless the third party is an official Partner. Any affiliate links or discount codes shared by a Freelancer are optional for the Client to use.

18. Amendments to These Terms

FWL Studios may revise these Terms at any time at our sole discretion. Material changes will be communicated through the Platform where reasonably practicable. Continued use of our services after a revision takes effect constitutes your acceptance of the updated Terms. If you do not agree with an update, you should discontinue use of our services.
